The age–old dilemma of free will and determinism is attacked by proving that both sides are flawed with contingencies, that the notion of eternal law is a theologically tainted projection rather than a reality of the real world that is understood to be evolutionary. Determinism is dissolved into conditionalism. This excludes materialistic scientific explanation of the deterministic style. As it brings forth freedom, evolutionary reality transcends essentially the explanatory possibilities of statistically structured natural laws. The impossibility of predicting the future allows us only to indicate which theological developments seem to be needed. These developments concern our changing perception of the world, which requires a reversal in our understanding of God's Creation, from its most imperfect beginnings to its unforeseeable future. The passing of evolution from the biological to the human level has opened moral dimensions that must be explored. Rather than return to the beginnings of the church, theology needs to try to understand Christian (...) faith within evolution, to reinterpret the past in the light of the new. In evolution, no final doctrine is possible. The necessity for doctrine creates a constant tension with the necessity of its revision. New truth must be paid for by suffering. The need is for a coherent theological vision of Creation, Redemption, and God's action in the world. Teilhard's metaphysics of union may be the key to it. In this view love becomes the central force of creation, which in Teilhard's view opens into an eternal future in God: in its final stage, evolution becomes Christogenesis. (shrink)

The aim of this thematic literature review is to explore nurses' perceptions of ethical issues in the care of older people. Electronic databases were searched from September 1997 to September 2007 using specific key words with tight inclusion criteria, which revealed 17 primary research reports. The data analysis involved repeated reading of the findings and sorting of those findings into four themes. These themes are: sources of ethical issues for nurses; differences in perceptions between nurses and patients/relatives; nurses' personal responses (...) to ethical issues; and the patient—nurse relationship. The findings reveal that ageism is one of the major sources of the ethical issues that arise for nurses caring for older people. Education and organizational change can combat ageist attitudes. Wider training is required in the care of older people, workplace skills, palliative care and pain management for older people. The demands of a changing global demography will necessitate further research in this field. (shrink)

BackgroundBiobanking biospecimens and consent are common practice in paediatric research. We need to explore children and young people’s (CYP) knowledge and perspectives around the use of and consent to biobanking. This will ensure meaningful informed consent can be obtained and improve current consent procedures.MethodsWe designed a survey, in co-production with CYP, collecting demographic data, views on biobanking, and consent using three scenarios: 1) prospective consent, 2) deferred consent, and 3) reconsent and assent at age of capacity. The survey was disseminated (...) via the Young Person’s Advisory Group North England (YPAGne) and participating CYP’s secondary schools. Data were analysed using a qualitative thematic approach by three independent reviewers (including CYP) to identify common themes. Data triangulation occurred independently by a fourth reviewer.ResultsOne hundred two CYP completed the survey. Most were between 16–18 years (63.7%, N = 65) and female (66.7%, N = 68). 72.3% had no prior knowledge of biobanking (N = 73).Acceptability of prospective consent for biobanking was high (91.2%, N = 93) with common themes: ‘altruism’, ‘potential benefits outweigh individual risk’, 'frugality', and ‘(in)convenience’.Deferred consent was also deemed acceptable in the large majority (84.3%, N = 86), with common themes: ‘altruism’, ‘body integrity’ and ‘sample frugality’. 76.5% preferred to reconsent when cognitively mature enough to give assent (N = 78), even if parental consent was previously in place. 79.2% wanted to be informed if their biobanked biospecimen is reused (N = 80).ConclusionProspective and deferred consent acceptability for biobanking is high among CYP in the UK. Altruism, frugality, body integrity, and privacy are the most important themes. Clear communication and justification are paramount to obtain consent. Any CYP with capacity should be part of the consenting procedure, if possible. (shrink)

Constitutional review was the most original idea stemming from the Austrian Federal Constitution of 1920. It is argued that the politician Karl Renner gave birth to the idea of a constitutional court. Hans Kelsen played the predominant role in the drafting of constitutional provisions. The new Constitutional Court provided for a centralized system of review, with an eye to a number of politically important issues. Owing to the pressure that stemmed from various discussions between and among the politicians of (...) the national state and the Länder, Kelsen was obliged to depart from the German model of the federal state and to develop in its place a new theory. Dabei fällt auf, dass die in Politik und Gesellschaft erfolgten Deutungen des Bösen geprägt sind durch klare Grenzziehungen zwischen "gut"und "böse", die zunehmend auch auf religiöse Kategorien wie Licht-Finsternis, gerecht-sündig, Tod-Leben rekurrieren. Dies provoziert die Frage nach der Trennschärfe von "gut"und "böse": Wo genau verläuft die Grenze zwischen "gut"und (...) "böse"und wer zieht diese Grenze? Ist "das Böse"eine unabhängige Größe oder tritt es vielmehr in Vermischung mit "dem Guten"auf? En este artículo exponemos las intuiciones del teólogo y biólogo alemán Karl Schmitz-Moormann sobre la evolución. Como leitmotiv subyacente en toda su obra, Schmitz-Moormann tiene a Teilhard de Chardin. Inspirado por Teilhard y su metafísica de la unión, introduce un nuevo concepto, a saber, la uni-totalidad. Veremos aquí cómo Schmitz-Moormann observa diversas uni-totalidades a lo largo del progreso evolutivo, desde las partículas subatómicas hasta las agrupaciones humanas. Esas diversas uni-totalidades implican, a la vez, diversidad de unión, (...) que puede ser explicada por causas que van desde la interacción nuclear hasta el amor interpersonal. ArgumentThe paper is based on a hitherto unexplored document (audiotape of an interview accompanied by a German transcript) from 1953, located in the Freud Papers at the Library of Congress. It contributes to a better understanding of the impact of Freud and of Psychoanalysis on personalities from the exact sciences, here represented by the noted applied mathematicians Richard von Mises and Hilda Geiringer from Vienna. The detailed discussion of the interview sheds some new light on the different roles of Kraus (...) and Freud in the Vienna culture, on the Vienna Jugendkulturbewegung (youth culture movement) during WWI in which Geiringer was involved, on Freud’s and Siegfried Bernfeld’s standing around 1930 among German philosophers and psychologists, and on Wilhelm Fließ’ theory of periodicity, which von Mises—based on his attitude as an applied mathematician—defended against superficial accusations. Finally, new biographical material is provided for von Mises and the remotely related Freud family, and for Geiringer’s and von Mises’ early lives. The interview, which was taken during the Cold War, also allows conclusions as to how politics influenced the memories and views of the participants. Part of the aim of the paper is historical documentation of unknown material (letters by Karl Kraus and Wolfgang Köhler, one book review by Wilhelm Ostwald, a file on Richard Pfennig), including some correction of erroneous information in the literature. Karl Schmitz‐Moormann argues that the doctrines of God and Creation, usually explicated in Roman Catholic theology by using the analogy of being, must rather be conceived in light of evolution and an analogy of becoming. God the Trinity, characterized by unity, information, and freedom, provides the image toward which the creation tends in its evolutionary processes. How can people function appropriately and respond normatively in social contexts even if they are not aware of rules governing these contexts? John Searle has rightly criticized a popular way out of this problem by simply asserting that they follow them unconsciously. His alternative explanation is based on his notion of a preintentional, nonrepresentational background. In this paper I criticize this explanation and the underlying account of the background and suggest an alternative explanation of the normativity of elementary social practices (...) and of the background itself. I propose to think of the background as being intentional, but nonconceptual, and of the basic normativity or proto-normativity as being instituted through common sensory-motor-emotional schemata established in the joint interactions of groups. The paper concludes with some reflections on what role this level of collective intentionality and the notion of the background can play in a layered account of the social mind and the ontology of the social world. After outlining why the notion of conscious control of action matters to us and after distinguishing different challenges to that notion, the contribution focuses on the challenge posed by the literature on unconscious goal pursuit. Based on a conceptual clarification of the notion of consciousness, I argue that the understanding of consciousness in that literature is too restricted. The hypothesis that the behaviors reported can be accounted for by nonconceptual forms of consciousness, such as emotions and motor experiences, rather than (...) by—conscious or unconscious—conceptual level intentions tends to be disregarded, even though it promises to be empirically fruitful. Das Gendiagnostikgesetz verbietet seit 2010 die pränatale Diagnostik spätmanifestierender Erkrankungen GenDG). In seiner Begründung bezog sich der Gesetzgeber in Analogie zu internationalen Empfehlungen für den pädiatrischen Bereich vor allem auf das Recht des heranwachsenden Kindes bzw. des späteren Erwachsenen auf Nichtwissen. Mit diesem gesetzlichen Verbot hat Deutschland einen viel diskutierten Sonderweg in der Regulierung genetischer Pränataldiagnostik eingeschlagen. Seither jedoch hat sich nicht nur die Perspektive auf prädiktive Testungen im Kindesalter verändert. In zunehmendem Maße generieren auf das gesamte Genom abzielende Diagnostikangebote (...) auch andere vorgeburtlich genetische Informationen, die – in ähnlicher Weise wie diejenigen zu spätmanifestierenden Erkrankungen eine potenzielle Gefahr für das Recht auf Nichtwissen der späteren Person darstellen. Es soll daher im Rahmen dieses Beitrages überprüft werden, inwiefern das deutsche Diagnostikverbot und dessen Bezug auf das Recht auf Nichtwissen des späteren Kindes eine tragfähige Basis zur Regulierung gendiagnostischer Untersuchungen in der Pränatalmedizin insgesamt darstellt bzw. zukünftig darstellen kann.Untersucht wird der Argumentationsgang des Diagnostikverbotes im Hinblick auf spätmanifestierende Erkrankungen vor dem Hintergrund der Entwicklungen in der prädiktiven Diagnostik. Eine Analyse des normativen Begründungsrahmens zeigt, dass nach wie vor deutlicher Klärungsbedarf hinsichtlich der philosophisch-ethischen Fundierung wie auch hinsichtlich der Interpretation eines Rechts auf Nichtwissen eines Kindes im Kontext von genetischer Diagnostik besteht. Darüber hinaus müssen auch Interessen des Kindes an eventuell möglich werdender pränataler Behandlung oder Prävention von Erkrankungen in die Abwägung miteinbezogen werden.Um zukünftigen Herausforderungen genomischer Pränataldiagnostik und -therapie begegnen zu können, müsste dringend geklärt werden, inwiefern Rechte zukünftiger Personen tatsächlich in der speziellen Situation der Schwangerschaft relevant sein können und mit welchen Pflichten diese für den Gesetzgeber, aber insbesondere auch für zukünftige Eltern und Ärzte einhergehen. Der Menschenrechtsdiskurs könnte hierfür eine tragfähige Basis und hilfreiche Strategien liefern. (shrink)

SchmitzWhen Tzvetan Todorov edited a special issue of the journal Communications on vraisemblance (verisimilitude) in 1968, he described the origin of the concept as follows (I paraphrase):One day during the fifth century B.C., there was a trial in some Sicilian city. Neither the plaintiff nor the defendant could produce witnesses or any other form of evidence to corroborate their version of the events, (...) so they had to convince the judges by the sheer power of their arguments. This was the day the principle of vraisemblance was discovered.Todorov's tongue-in-cheek explanation refers to a concept which in Greek was called. The word combines two aspects that modern logic differentiates: the "objective" meaning of probability (what is probable by the laws of nature) and the "subjective" meaning of plausibility (what the addressee of a message considers plausible). Aristotle's use of the word shows that the Greek concept does not draw a sharp distinction between these two elements.1 Their intricate connection becomes evident in, e.g., his Rhetoric (2.25 1402b14-16) where he defines enthymemes. They are drawn from probability, he explains, when they are based upon things which occur regularly or are perceived to occur regularly (). For they are likely to trust these statements most.Anaximenes thus defines as an attentiveness to the public's assumptions rather than an objective quality inherent in certain facts. Thus not only is the author of the hymn familiar with this particular form of argument, he also knows that it can be employed deceptively. Modern nursing evolved out of a war. Today’s nurses not only work in war zones but the profession as a whole needs to consider its responsibility in caring for victims of conflict and what its international duty is in preventing wars. This means that nurses must be informed of the devastation caused by conflict not only in countries where conflicts and war take place but also world-wide. Nurses’ responsibility is to prevent illness and alleviate suffering, which includes the long-term morbidity (...) caused by wars. They need to be more politically active in conflict resolution and prevention at local, community, national and international levels. The purpose of this article is to address these issues from an ethical perspective and to suggest implications for nursing education and practice. (shrink)

In diesem Aufsatz argumentiere ich, dass die Standardauffassung von Propositionen und propositionalen Einstellungen inadäquat ist, ein Artefakt der gegenwärtig herrschenden theorielastigen Auffassung von Intentionalität, Sprache und Rationalität, und skizziere eine alternative Auffassung. Im folgenden Abschnitt belege ich erst einmal die These der Theorielastigkeit anhand einiger Beispiele vor allem aus der gegenwärtigen analytischen Philosophie. Der dritte Abschnitt erklärt, wie diese Theorielastigkeit im Standardverständnis von Propositionen und propositionalen Einstellungen verkörpert ist. Im vierten Abschnitt argumentiere ich, dass dieses Standardverständnis der Proposition zwei unvereinbare (...) Rollen zuweist. Sie kann nicht sowohl einen Sachverhalt repräsentieren, der Gegenstand praktischer genauso wie theoretischer Stellungnahmen sein kann, als auch wie eine theoretische Stellungnahme Wahrheitswertträger sein. In den folgenden Abschnitten versuche ich eine partielle Diagnose, wie es zu dieser Auffassung kommen kann: gewisse Formen der Neutralisierung von Stellungnahmen durch das bloße „in den Raum stellen“ (fünfter Abschnitt), durch fiktionale Kontexte (sechster Abschnitt) und den Kontext logischer Verknüpfungen (der so genannte „Frege-Punkt“; siebter Abschnitt) werden verwechselt mit der Neutralität zwischen dem Praktischen und Theoretischen, zwischen Wollen und Wahrheit, die die Standardauffassung erfordern würde. Der achte Abschnitt skizziert in groben Umrissen ein alternatives Bild. Demnach wird eine Repräsentation eines Sachverhalts erst durch die dazu kommende theoretische oder praktische Position zu einer Stellungnahme und damit zum Träger eines Erfüllungswerts. Die Bereiche des Praktischen und des Theoretischen sind parallel strukturiert und unterschieden sich im Wesentlichen nur durch die Verschiedenheit der Passrichtungen. Grundlegende rationale Operationen wie Deduktion, Abduktion und Induktion können auf praktischen Stellungnahmen genauso ausgeführt werden wie auf theoretischen. Im neunten Abschnitt verorte ich die tieferen Wurzeln der Theorielastigkeit in dem Verlangen, das Praktische an die dem Theoretischen eigene Form der Objektivität zu assimilieren. Dieses Verlangen muss aber fruchtlos bleiben, und die dem Praktischen eigene Form der Objektivität wird so verfehlt. Der letzte Abschnitt deutet an, wie sich Werturteile in dem skizzierten Rahmen deuten lassen. (shrink)

Questions are not on all fours with assertions or directions, but higher-level acts that can operate on either to yield theoretical questions, as when one asks whether the door is closed, or practical questions, as when one asks whether to close it. They contain interrogative force indicators, which present positions of wondering, but also assertoric or directive force indicators which present the position of theoretical or practical knowledge the subject is striving for. Views based on the traditional force-content distinction take (...) the indicative mood for granted and therefore do not understand assertion in contrast to direction, but in contrast to questions and other higher-level acts such as logical and fictional acts. But a corresponding sign like Frege's judgement stroke can only redundantly signal the absence of a higher-level act. (shrink)

In addition to the Frege point, Frege also argued for the force-content distinction from the fact that an affirmative answer to a yes-no question constitutes an assertion. I argue that this fact more readily supports the view that questions operate on and present assertions and other forceful acts themselves. Force is neither added to propositions as on the traditional view, nor is it cancelled as has recently been proposed. Rather higher level acts such as questioning, but also e.g. conditionalizing, embed (...) assertive or directive acts that are forceful and committal, while suspending commitment to them. The Frege point confounds different varieties of force and the question whether something is merely presented for consideration with the question what is so presented. Force is representational: through assertoric and directive force indicators subjects non-conceptually present positions of theoretical or practical knowledge, while interrogative acts indicate positions of wondering which strive for such knowledge. How can consciousness, how can the mind be causally efficacious in a world which seems—in some sense—to be thoroughly governed by physical causality? Mental causation has been a nagging problem in philosophy since the beginning of the modern age, when, inspired by the rise of physics, a metaphysical picture became dominant according to which the manifest macrophysical world of rocks, trees, colors, sounds etc. could be eliminated in favor of, or identified with, the microconstituents of these entities and their basic (...) physical properties, plus their effects on human or animal minds. Against the background of this ontology, the argument from causal closure, or the causal completeness of physics, exerts strong pressure to also identify consciousness with microphysical entities—or even to eliminate it in favor of the latter—the only other options apparently being either the denial of the causal closure of the physical level, epiphenomenalism about the mind, or the view that its physical effects are generally overdetermined. In this paper, however, I want to introduce what I call the “microstructure view” (MV) of the brain-consciousness relation, and I want to try to make plausible that the problem of mental causation can also be solved, or perhaps rather dissolved, on the basis of this account. On the MV, the minimal neuronal correlates of consciousness—of the global state of consciousness, or specific states of consciousness such as pain—are not identical with these states, but rather constitute their microstructure, or, as I shall also say, equivalently, compose them. Harry S. Broudy has studied the utility of general education through the development and testing of his Newspaper Test of the Uses of Schooling (NPT). The results of research with a new version of the NPT are reported in this essay and some options for future research are presented. The results of the study indicate that continued development and testing of the NPT will prove important. Promising new versions of the test are suggested for future research to pursue, including a (...) Hypertest version. Additional instruments and research strategies are also suggested that could be used to broaden the "search for evidence" of the uses of schooling. (shrink)

The link between oncogenesis and normal development is well illustrated by the study of the Wnt family of proteins. The first Wnt gene (int‐1) was identified over a decade ago as a proto‐oncogene, activated in response to proviral insertion of a mouse mammary tumor virus. Subsequently, the discovery that Drosophila wingless, a developmentally important gene, is homologous to int‐1 supported the notion that int‐1 may have a role in normal development. In the last few years it has been recognized that (...) int‐1 and Wingless belong to a large family of related glyco‐proteins found in vertebrates and invertebrates. In recognition of this, members of this family have been renamed Wnts, an amalgam of int and Wingless. Investigation of Wnt genes in Xenopus and mouse indicates that Wnts have a role in cell proliferation, differentiation and body axis formation. Further analysis in Drosophila has revealed that Wingless function is required in several developmental processes in the embryo and imaginal discs. In addition, a genetic approach has identified some of the molecules required for the transmission and reception of the Wingless signal. We will review recent data which have contributed to our growing understanding of the function and mechanism of Drosophila Wingless signaling in cell fate determination, growth and specification of pattern.
